Terms of Service – KiraClip

These Terms of Service (hereinafter the "Terms") govern the use of the KiraClip service. By accessing or using KiraClip, you agree to these Terms without reservation.

Article 0 – Eligibility

The service is strictly reserved for users aged 18 or older. By using KiraClip, the user confirms being legally capable of entering into binding agreements.

Article 1 – Purpose of the Service

KiraClip is a SaaS service that automatically generates short video clips from videos provided by the user (upload or YouTube link). The service is only accessible through subscription or one-time pack purchases.

Article 2 – Content Responsibility

The user guarantees that they have all necessary rights to the videos they submit (ownership or authorization). They are solely responsible for the legality and compliance of all submitted content, including copyright, image rights, and third-party platform terms of use.

The user agrees to indemnify KiraClip against any claims, legal actions, or damages resulting from the use of unauthorized or non-compliant content.

Article 3 – Role of KiraClip

KiraClip acts solely as a technical content processing tool. KiraClip does not verify ownership, authenticity, or legality of submitted videos. KiraClip is not responsible for rights violation claims, content takedowns, or sanctions imposed by third-party platforms.

KiraClip reserves the right to remove any content or suspend access to the service in case of abuse, violation of these Terms, or legal risk, without notice.

Article 4 – Access, Subscriptions, and Payments

Access to the service is conditional on purchasing a subscription or one-time pack. Payments are processed by third-party payment providers, including Stripe. KiraClip does not store any payment information. The user may cancel their subscription at any time; cancellation takes effect at the end of the current period. No retroactive refunds will be granted for partially used periods, unless required by law.

KiraClip reserves the right to modify prices with reasonable notice. In case of non-payment, access to the service may be suspended without notice.

Article 4.1 – Digital Delivery

KiraClip provides exclusively digital services. Access to the service and credits is granted immediately after payment confirmation. No physical goods are shipped.

Article 4.2 – Refund & Cancellation Policy

All purchases are final once the service has been accessed or credits have been consumed. Due to the digital and on-demand nature of the service, no refunds are provided after service activation, except where required by applicable law.

Subscription cancellations take effect at the end of the current billing period. Unused credits are not refundable.

Article 5 – Limits and Availability

Service access is limited by usage units according to the subscribed plan. KiraClip reserves the right to modify these limits with reasonable notice.

The service is provided "as is". KiraClip strives to ensure continuous availability but does not guarantee uninterrupted access. The service may be temporarily unavailable (maintenance, technical failures, force majeure). KiraClip is not responsible for losses resulting from unavailability, interruption, or degradation of the service, including data loss.

Submitted videos and generated clips are stored on our servers for a maximum of 90 days from submission or generation. After this period, videos and clips may be permanently deleted without notice. Users are advised to download and save their content before this deadline.

Article 6 – Liability

To the extent permitted by law, KiraClip's liability is limited to the total amount paid by the user during the twelve (12) preceding months. KiraClip shall not be liable for any indirect, consequential, or incidental damages (loss of profits, loss of revenue, data loss, reputational harm, etc.).

KiraClip shall not be liable for claims arising from third-party platforms, copyright enforcement, or content takedowns.

The user may terminate their account at any time. KiraClip reserves the right to suspend or terminate access in case of violation of these Terms, fraudulent or abusive use, or non-payment, without notice.

Article 6.1 – Sanctions & Restricted Countries

KiraClip does not provide services to individuals or entities located in countries subject to international sanctions, including OFAC-restricted jurisdictions.

Article 6.2 – Service Modifications

KiraClip reserves the right to modify, suspend, or discontinue any part of the service, features, pricing, or usage limits at any time, with or without notice.

Article 6.3 – Abuse & Misuse

Any attempt to abuse the service, bypass usage limits, automate access, or misuse the platform may result in immediate suspension or termination without refund.

KiraClip may retain technical logs and usage data for purposes of evidence, security, abuse prevention, and dispute resolution.

Article 7 – Applicable Law

These Terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the competent French courts, subject to mandatory provisions of applicable law.

KiraClip reserves the right to modify these Terms at any time. Modifications take effect upon publication. Continued use of the service constitutes acceptance of the modified Terms.

In case of discrepancy between language versions, the French version shall prevail.
